One of two Bryan men accused of knocking out a convenience store clerk in College Station last October is headed to prison.
The Brazos County district attorney’s office says 19 year old Nicholas Troy Bogert II entered a guilty plea to aggravated robbery at the beginning of a jury trial.The jury then spent three hours to decide punishment of 17 years.
According to prosecutors, Bogert was eligible to receive probation from the jury because he had never before been convicted of a felony.
Bogert testified during the trial and admitted his involvement in the robbery, while requesting that the jury give him probation.
Court records indicate the co-defendant, 19 year old Jordan Krob, will go to trial in November.
They were arrested after surveillance video was released from the Gateway Exxon on University at the freeway, where the clerk was found unconscious after he was struck on the head while taking out the garbage.
An undisclosed amount of money was taken.
Bogert will have to serve half of his sentence before becoming eligible for parole.
