According to a press release from the Grimes County District Attorney’s Office, “On Tuesday, December 17, 2024, Jimmie Lee Peavy Jr., age 51, pled guilty to Harassment of a Public Servant.
On November 30, 2023, the Navasota Police Department responded to a disturbance in progress at Stripes convenience store located at Hwy 105 East and Hwy 6.
The reporting party told law enforcement officials that Jimmie Peavy and another male were fighting in the parking lot. Police officers arrived and made contact with Peavy, who was found to be intoxicated.
Sgt. Todd Moon placed Jimmie Peavy in custody for Public Intoxication when Peavy began to exhibit signs of aggression toward another police officer on scene.
After being placed under arrest, Jimmie Peavy made threats against Sgt. Moon. Peavy then spit on and kicked Sgt. Moon inside the Grimes County Jail during the intake process. Peavy was charged with Retaliation, Harassment of a Public Servant and Assault on a Public Servant.
On Tuesday, December 17, 2024, a jury panel was summoned to hear the case against Jimmie Peavy. After a jury was selected, visiting District Judge JD Langley heard a motion to suppress filed by the Defense.
After hearing evidence and argument by both the State and Defense, Judge Langley found the arrest was not unlawful and denied the motion.
Following the hearing, Jimmie Peavy pled guilty to Harassment of a Public Servant, a Third-Degree Felony. Peavy was sentenced to 35 years in prison in a plea agreement made by District Attorney Andria Bender.
Peavy faced a habitual offender punishment range due to his prior felony convictions.
Jimmie Peavy will remain in the custody of the Grimes County Jail until he is transferred to the Texas Department of Criminal Justice.”
