A jury trial is underway in federal court involving former Blue Bell president Paul Kruse.
This comes seven years after a listeria outbreak at the ice cream producer that killed three people and sickened ten others. Prosecutors say Kruse concealed information from consumers about what Blue Bell knew about the contamination.
The indictment also accuses Kruse ordered staff to pull Blue Bell from store shelves but did not give a reason. Blue Bell officials say this trial is between Kruse and the federal government.
Two years ago, the company agreed to pay more than 19 million dollars in fines after pleading guilty to shipping a contaminated product.
