Texas Attorney General Office argues Texas Central cannot use eminent domain in latest update

December 22, 2021 by Willy1550

Attempts by a Leon County landowner to get the Texas Supreme Court to bar Texas Central officials from surveying his land now have support of the Texas Attorney General’s Office.

The AG’s office filed briefs in support of Jim and Barbara Miles, writing that railroads have the power of eminent domain. However, Texas Central has failed to demonstrate they are an actual railroad, saying they have failed to show likelihood they will raise enough money to finish the project.

Texas Central has not released a response, but has said previously they do not want to use eminent domain, and hope to work out sales agreements with landowners along the route.
